Applicability

ERB is the publisher of the magazine ‘European Review of Books’ and offers an online service through its website. Every visit to the ERB website and the use of the ERB account are subject to these terms and conditions of use (hereinafter ‘Terms of Use’). 

By visiting the website, you implicitly and unconditionally agree to the applicability of these Terms of Use. By creating an ERB account, you expressly agree to these Terms of Use. ERB may modify these Terms of Use at any time. The amended Terms of Use will be effective upon posting. The date of the latest version of the Terms of Use can be found at the top of this page. We therefore recommend that you check the Terms of Use regularly.

Despite the constant care and attention ERB pays to the composition of its website, it is possible that information published on this website is not complete, correct or current. The information provided on or through this website is subject to change and any changes may be made at any time with immediate effect and without notice. ERB does not warrant that the website will be available at all times without interruption. ERB reserves the right to optimize or modify the technical characteristics and accessibility of the website without notice. ERB excludes all liability for any direct or indirect damages of any kind arising from or in any way related to the use of the website, the use of information obtained through the website, or the temporary inability to access the website.

Access to and use of our website

You have the right to use our website for private purposes. Commercial use (such as using (parts of) the website to obtain advertising revenue or (partial) copying the content) is prohibited. The rights relating to ERB’s trademarks and associated logos, such as copyright and trademark rights, belong exclusively to ERB. ERB expressly reserves these rights.

The intellectual property rights (including copyright-, database- and related rights) relating to the content and layout (the data, images, sounds, texts and other information contained therein) of the website and digital editions of the ERB brand belong exclusively to ERB. These contents and formatting are intended for personal, non-commercial use only. To copy, store and distribute (parts of) the content and use of the design in any way, you must obtain prior written consent from ERB or the rightful claimant. Re-use of ERB material is in principle not allowed, unless you have a written permission from ERB. ERB may charge a fee for the reuse of an article. If you have permission from ERB to post an article, you must cite the source (article title, magazine title (European Review of Books, author, and date). The permission applies only to the text and not to any attached photographs and/or illustrations, for which you must contact the photographer/illustrator for any permission and conditions of use. We further stipulate that you will indemnify us against any third-party claims arising from the use of such material.

ERB Account

If you create an ERB account on our website, you expressly agree to:

1. provide accurate, current, and complete information as prompted by ERB account creation, and

2. promptly update this information in the event of any changes.

You will receive a confirmation email after creating an ERB account. Your login details (username and password) are strictly personal. It is not permitted to exploit the login details or give the login details to third parties. If you suspect that your login details have come into the hands of a third party, you are obliged to inform ERB immediately.

ERB has the right at all times to block an ERB account temporarily or permanently, for example if, in ERB’s opinion, a user is in breach of these Terms of Use.

Privacy

ERB’s Privacy Statement applies to the processing of personal data through ERB’s website and apps and is an integral part of these Terms of Use.

Final Determination

These Terms of Use and any disputes relating to them or to the use of ERB account are governed by Dutch law. The courts of Amsterdam shall have exclusive jurisdiction with respect to such disputes.
